Introduction

We at Limitless Innovative Technologies LLC ("we", "us", or "our") provide mobile applications and web applications ("Services"). These Terms and Conditions ("Terms") apply to your access of any of our Services where these Terms and Conditions are posted or linked.

Intellectual Property

All the content of our Services – including text, software, scripts, code, designs, graphics, images, screens, pages, photos, sounds, music, videos, applications and other content are owned or licensed to Limitless Innovative Technologies LLC. You do not acquire any ownership rights to any trademarks, service marks, or trade names through your access or use of this Service. You agree to not copy, edit, display, distribute, transmit, create derivative works, or in any way exploit this content.

Service Use

You agree to use this Service in accordance with these Terms and Conditions. You agree not to: use this Service in a way that could damage, overburden, or disrupt the Service and its system or servers; modify or reverse engineer the Service; use the Service in way that is unlawful or malicious; attempt to gain unauthorized access to accounts or systems; transmit, submit, post, or include any unlawful, harmful, harassing, defamatory, vulgar, obscene, threatening, abusive, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable content, material, or information of any kind, or any content, material, or information that may give rise to criminal or civil liability; use any manual or automatic program, process, or method to monitor or obtain materials through ways that are not purposely made available through our Service.

User Content

Our Services may allow you to create, store, or share content such as budget names, notes, comments, or other information ("User Content"). You retain ownership of your User Content. By submitting User Content through the Services, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display that User Content solely for the purpose of operating and providing the Services.

You are responsible for the User Content you submit, including ensuring that it does not infringe the rights of any third party, violate applicable law, or contain unlawful, harmful, or offensive material. We reserve the right (but have no obligation) to remove any User Content that we believe violates these Terms.

You also retain all rights to your financial and budget data, including budgets, envelopes, and transactions. We do not claim ownership of this information; we only process it to provide and improve the Services.

Eligibility and Age

You must be at least 13 years old to use our Services. If you are located in the European Economic Area or the United Kingdom, you must be at least 16 years old, unless your country allows parental consent for younger users (not below age 13). By using the Services, you represent and warrant that you meet the applicable age requirements.

Subscriptions and Payments

Some features of the Services are offered as paid subscriptions. Subscriptions and payments are processed by Apple App Store, Google Play, and RevenueCat, and are subject to their respective terms and conditions. We do not directly process payment card information. You are responsible for managing your subscriptions through your app store account.

Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your breach of these Terms; (2) any breach of your representations and warranties set forth in these Terms; (3) your activities in connection with our Services.

Termination

These Terms shall remain in full force and effect while you use the Service. Without limiting any other provision of these terms, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Service, to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these terms or any applicable law or regulation. We may terminate your use or participation in the site or delete your account and any content or information that you posted at any time, without warning, in our sole discretion.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

No Promises

This Service is provided on an 'as is' and 'as available' basis without any promises or representations, express or implied. In particular, we do not warrant or make any representations regarding the validity, accuracy, reliability or availability of the Service or its content. To the fullest extent permitted by applicable law, Limitless Innovative Technologies LLC hereby excludes all promises, whether express or implied, including any promises that the Service is fit for purpose, of satisfactory quality, non-infringing, is free of defects, is able to operate on an uninterrupted basis, that the use of the Service by you is in compliance with laws or that any information that you transmit in connection with this Service will be successfully, accurately or securely transmitted.

Limitations of Liability

UNDER NO CIRCUMSTANCES SHALL WE OR ANY OF OUR SERVICE PROVIDERS BE LIABLE TO ANYONE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, INCLUDING, BUT NOT LIMITED TO, ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES (LOST PROFITS, BUSINESS INTERRUPTION, OR LOSS OF INFORMATION, PROGRAMS, OR DATA) RESULTING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Alabama.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Limitless Innovative Technologies LLC regarding the Services and supersede all prior agreements, understandings, and representations, whether written or oral, with respect to the Services.

Modifications to the Terms and Conditions

We reserve the right to revise or update these Terms and Conditions. Any updates will be indicated by a "last updated" notice at the top of this page.
